    General Policies:

    GATZA is a custom manufacturer building parts just for you. Due to the custom nature of manufacturing, delays occasionally happen. GATZA cannot be held responsible for any costs incurred due to delays or Supply chain shortages. These costs include but are not limited to installation costs, labor costs, rental costs, mortgage rate costs, and certificate of occupancy costs.

    GATZA is not responsible for scheduling conflicts with contractors when an order is delayed. We recommend you wait until you have received your product before scheduling installers or contracting our PRO Installation Service ( Available in selected areas)

    Ship dates:

    As a custom manufacturer, occasionally, issues occur in production which require either part or sometimes all of your order to be reproduced, resulting in shipping delays.

    We make every effort to be on time, but our number one goal at GATZA is quality. We prefer to send you unique parts late than poor quality parts on time.

    GATZA cannot be responsible for additional costs (labor costs, rental costs, mortgage rate costs, certificate of occupancy costs, etc.) due to delays in manufacturing or shipping.

    Payment:

    For orders under $5,000, full payment is due at ordering.

    Any other orders require a 20% non-refundable deposit (exceptions are when the job site has space limitations that make engineering impossible) to prepare the Shop Cad Drawings of your project and approval of the plans is required.

    After plans are approved for the production of your Custom Modern Floating Stairs & Railings System, we require a 40% payment for production to begin.

    Once your GATZA Modern Stairs & Railing System is complete, we require the remaining balance to be paid before shipment.

    PRO Installation of your GATZA Modern Stairs & Railings will be sent on the same invoice if contracted.

    Production begins once the client approves the Shop CAD drawings and 60% of the project amount has been received.

    Pricing & Promotions

    Pricing for all orders is subject to change at any time.

    GATZA Co. reserves the right to adjust the order after the fact if a pricing error occurs.

    Estimates provided to customers by Us are good for 14 days. However, the discount may change based on current promotions.

    Pricing provided to customers via email from GATZA Co. is merely an estimate and is not final pricing. The final pricing is sent via an estimate app, including all detailed supplies, for customer approval.

    Locked-in pricing is only available under the following conditions:

    Project scope and/or design are not modified.

    GATZA Co. will honor your initial order price for six months if you place an order with a down payment. Beginning in the seventh month, GATZA Co. will assess a 1% price increase to each month's total order.

    Any order remaining open over a period of 24 months will be subject to repricing. If the costs of goods sold increase by 20% or more, GATZA Co. reserves the right to reprice or cancel the order.

    Production & Lead Times

    Due to the custom production of all GATZA Co. products, no changes can occur once an order is released into production.

    Lead times provided to customers are merely estimated business days of production and do not include shipping time. While delays in production and shipping can occur, GATZA Co. is not responsible for any costs to customers or any contractor scheduling conflicts resulting from these delays.

    After an order is released to production, it will be shipped upon completion. If a customer requests storage of a product for more than five business days, GATZA Co. reserves the right to assess a storage fee of up to $100 a day.

    Production takes 70-90 business days.

    Order Cancellation

    Orders placed but not released to production may be assessed a fee for work completed by our engineering department, and Non-engineered orders will not be considered a cancellation fee.

    Cancellations within 90 days, the fee will be up to 10% of the product total.

    For cancellations between 91-180 days, the fee will be up to 25% of the product total.

    Cancellations after 180 days, the fee will be up to 50% of the product total.

    Cancellations are not accepted after an order has been released to production, and this typically takes place within the same business day of placing the order. For engineered products, this may take longer.

    Code Compliance

    Building code compliance requirements vary significantly from location to location. Therefore, GATZA Co. is not liable for orders that do not comply with applicable building codes specific to the customer's installation location. The customers' responsibility is to ensure compliance with any applicable building codes. Local building code requirements will always supersede any suggested procedures and measurements offered by GATZA Co.

    Damages & Shortages

    Product defects and shortages must be reported within five business days of receiving a product via email to contact@modernstairsusa.com

    Damage claims filed after the product has been installed will not be honored, regardless of when the claim is filed.

    For LTL shipments received that appear damaged, please accept delivery. The packaging may be damaged in most cases, but the product is not. GATZA Co. will replace any confirmed damaged items.

    In the event of a damage claim, GATZA Co. will require a photo or video of the issue and may need the part returned. All solutions and/or replacements are at the discretion of GATZA Co.

    Any product remakes and/or refunds are up to the discretion of GATZA Co.

    Disputes

    We sometimes make mistakes but stand behind our product and processes. We are committed to the success of our customer's products and will work with customers to achieve success.

    Engineering

    Almost all GATZA Co. products are custom manufactured. Therefore, the customer is responsible for providing accurate measurements and noting important structural details and possible obstructions. All custom products must have signed prints before being released to production.

    GATZA Co. is not responsible for additional parts and/or replacement parts required, which are not noted in the final proposal and/or drawings.

    Incorrect Usage or Installation

    GATZA Co. assumes no responsibility or liability for any loss or damage resulting from misusing any GATZA Co. product(s) or instruction(s). GATZA Co. assumes no responsibility or liability for any loss or damage resulting from the use or misuse of information on this website. Engineering drawings, diagrams, and product quotes are not meant to replace a licensed construction professional, and the customer or contractor assumes all responsibility regarding worksite safety.

    Returns

    All returns must be made within 180 days of order shipment. To be eligible for a return, products must be resellable and cannot be damaged. Returns are assessed at a 25% restocking fee, and a return Goods Authorization (RGA) form must be completed for all returns.

    All wood, glass, and most metal products cannot be returned.

    Reinforced Aluminum/ Stainless Steel Handrails

    Fittings and Tensioners

    Unopened spools of Stainless Steel cable

    Shipping

    All standard freight decisions are to be made at GATZA Co.’s discretion. GATZA Co. operates its delivery service in select regions.

    Small package deliveries will be made with UPS or US Mail. Express shipping is only available at the customer's cost, including remakes or additional products. Carrier tracking information is considered proof of delivery for all shipments.

    All orders with a handrail or rods over 8ft will be delivered via Less Than Truckload (LTL) Shipment. Large LTL shipments will be made with many LTL carriers.

    On standard LTL deliveries, damaged packages and/or missing parcels must be reported on the BOL before signing. The customer will be responsible for paying for replacement items if they fail to note damages and/or missing parcels on the BOL.

    Please note: if the shipping address changes after the product ships out from our facility, additional re-consignment fees from the shipping company will be applied to the customer.

    For crates, we recommend that you have 4-5 people on site for the delivery to get the products from the truck to where they need to go.

    A forklift rental can be helpful, and we recommend one for the delivery of glass panels.

    Terms

    These Terms shall be construed under the laws of the State of Connecticut. Any legal proceedings against GATZA Co. that arise out of, relate to, or be in any way connected with GATZA Co.’s services or these Terms of Use shall be brought exclusively in the courts of Litchfield County, Connecticut, and any jurisdictional venue or inconvenient forum objections to such courts are at this moment waived.
